1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you (whether an
individual contractor, builder, engineer or corporate entity) and BuildEz Technologies Private
Limited ("BuildEz", "we", "us", or "our") concerning your access to and use of the BuildEz mobile
application and website.
By registering on the application, placing an order or browsing our catalog, you agree that you have read,
understood and agreed to be bound by these Terms.
2. Eligibility and Account Registration
- You must be at least 18 years of age and capable of entering into legally valid contracts under the
Indian Contract Act, 1872.
- You agree to provide accurate, verified phone numbers for OTP authentication and valid site addresses
with landmarks.
- You are responsible for maintaining the confidentiality of your credentials and all orders placed under
your account.
3. Material Sourcing and Genuine Brand Guarantee
BuildEz guarantees that all branded construction materials are sourced directly from authorised
manufacturers or certified distribution channels:
- Manufacturer test certificates: batch-wise manufacturer test certificates (MTC) are
provided digitally on request for TMT steel rebar and cement consignments.
- Weight & measure verification: weighbridge slips and digital meter measurements are
generated for bulk commodities such as M-Sand, P-Sand, aggregate and steel rebar bundles.
4. 60-Minute Delivery Service-Level Agreement (SLA)
- Service-area coverage: the 60-minute delivery commitment applies to locations within the
designated operational radius of our micro-fulfillment hubs.
- Site accessibility: the client is responsible for unobstructed vehicular access, road
width clearance (minimum 12 feet for mini-tippers and medium trucks) and gate clearance at the site.
- Force majeure & exceptional delays: SLAs may vary during severe traffic, torrential
rain, waterlogging or municipal entry restrictions. Real-time GPS tracking is continuously updated in the
app.
5. Site Unloading and Handling Policy
- Standard delivery includes drop-off at the ground-level gate or driveway of the construction site.
- Additional unloading labour or floor-to-floor shifting requires prior selection of "Unloading Assistance"
at checkout at standardised labour rates.
- Vehicles must be unloaded within 30 minutes of arrival to avoid driver-detention charges.
6. Pricing, GST Invoicing and Payment Terms
- Dynamic daily wholesale rates: prices for cement, steel rebar and sand reflect live
wholesale market prices and are locked once checkout is confirmed.
- Tax invoicing: all orders are billed with GST tax invoices containing your verified
GSTIN for compliant input-tax-credit claims.
- Payment modes: UPI, NetBanking, credit/debit cards, pay-on-delivery (cash or UPI at the
gate) and pre-approved contractor credit lines.
7. Cancellation, Replacement and Return Policy
- Cancellations: free of charge before the vehicle departs the hub (typically within 5–10
minutes of order placement). Once en route, a nominal dispatch logistics fee may apply.
- Damaged or torn bags: any damaged, torn or moisture-affected cement bags must be noted on
the delivery receipt on arrival for immediate on-the-spot replacement or instant wallet refund.
- Grade & specification discrepancies: if delivered materials do not match the grade or
diameter on your invoice, BuildEz will exchange them immediately at zero extra cost.
8. Limitation of Liability
BuildEz shall not be liable for any indirect, consequential or incidental delays in site construction
progress, structural defects arising from incorrect on-site mixing ratios, or third-party engineering design
faults. Our aggregate liability is strictly limited to the total amount paid for the specific order under
dispute.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of
or in connection with these Terms are subject to the exclusive jurisdiction of the competent courts in
Chennai, Tamil Nadu, India.
